The following privacy notice is established in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Personal Data Law”). Please read the terms and conditions carefully as any provision of Personal Data you make by any means constitutes your express acceptance of these terms and conditions, and consequently, Colaboradores Smart, S. de R.L. is expressly authorized to process such data.
All terms with initial capital letters not defined in this notice shall have the meanings ascribed to them in the Personal Data Law.

Identity and Address of the Data Controller

The Data Controller for Personal Data is Colaboradores Smart, S. de R.L., with its registered address at Tabachin 112, Las Arboledas, Aguascalientes, Ags., Mexico, CP. 20020.

Purposes of Personal Data Processing

The data and/or information voluntarily provided to us or that has been provided to us is confidential. The purposes for which Colaboradores Smart, S. de R.L., collects Personal Data are as follows: A. Regarding its employees, to maintain proper internal control, as well as to process payments and provide the corresponding benefits arising from an employment relationship. Regarding prospective employees, to schedule job interviews, conduct evaluations, contact them, and maintain internal controls for tracking and potential hiring. B. Regarding its suppliers and customers, for purposes of identification, location, contact, shipments, processing payments, collections, statistics, to better provide the services and/or products they require, and for their transmission to third parties by any means permitted by law. In general, the Personal Data collected by Colaboradores Smart, S. de R.L., from the Data Subjects include names, age-related information, health conditions, movable or immovable properties subject to insurance, addresses, phone numbers, email addresses, and, in some cases, curriculum vitae information, as well as banking and tax details. If, at the time of collecting Personal Data, there is a purpose for the Processing of such data different from those indicated in this section, Colaboradores Smart, S. de R.L., will inform the Data Subject with the aim of obtaining their consent, if necessary, for the corresponding purpose.

Security Measures Regarding Personal Data.

It is the responsibility of the Data Subject to ensure that the data provided to Colaboradores Smart, S. de R.L., is accurate and complete. The Data Subject is also responsible for informing Colaboradores Smart, S. de R.L., of any changes to the data to ensure compliance with the obligation to keep the information up-to-date. The retention period for the Personal Data of the Data Subject will depend on the legal relationship established with Colaboradores Smart, S. de R.L., as well as the obligations imposed by current legislation and competent authorities. In all cases, the information will be stored only for a reasonable period. Colaboradores Smart, S. de R.L., has implemented and is committed to maintaining administrative, technical, and physical security measures that protect the Personal Data it collects against any damage, loss, alteration, unauthorized access, or processing.

Means to Exercise ARCO Rights.

To exercise the rights of access, rectification, cancellation, or opposition (“ARCO Rights”), in accordance with the provisions of the Personal Data Law, Data Subjects may submit a written request addressed to Aarón Roque at the following email address hola@smart-teaching.com or directly to the registered address of Colaboradores Smart, S. de R.L., as indicated above. The respective request for access, rectification, cancellation, or opposition must contain and include the following:

• Name of the Data Subject and address or other means for Colaboradores Smart, S. de R.L., to send the corresponding response to the respective request;
• Documents that prove the identity of the Data Subject or, where applicable, the legal representation of the person making the request on their behalf;
• A clear and precise description of the Personal Data for which the Data Subject wishes to exercise any of the rights of access, rectification, cancellation, or opposition;
• In the case of requests for rectification of Personal Data, the Data Subject should indicate, in addition to what is stated in this section, the modifications to be made and provide the documentation that supports their request, and;
• Any other element or document that facilitates the location of the corresponding Personal Data.

Colaboradores Smart, S. de R.L., will communicate to the Data Subject the determination taken, within a maximum period of twenty Days, counted from the date on which the corresponding request was received. This is so that, if deemed appropriate, it can be executed within fifteen Days following the date on which the response is communicated. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances justify it.

Modifications or Changes to the Privacy Notice.

With this Privacy Notice, the Data Subjects are duly informed about the data that was collected from them and for what purposes, accepting the terms contained herein, which were prepared in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties.
